Welcome to SpecXSmart, your next-generation hybrid eyewear platform. By accessing or using our website, tools, or services, you agree to be bound by the following Terms and Conditions. Please read them carefully. 

1. Overview of Services

SpecXSmart is a hybrid optical platform that merges online technology with traditional eye care. Our digital tools include: 

  • SpecXSizer – AI-powered facial mapping for personalized frame suggestions.
  • SpecXSorter – Smart filters to narrow down frame and lens options.
  • SpecXViewer – Augmented Reality try-on tool.
  • SpecXFusion – A 17-step customization process to build your perfect pair of glasses.

You remain in full control of your eyewear journey—from online selection to in-person support.

Our platform is built on WordPress, and we employ industry best practices to safeguard your information: 

  • Be at least 18 years old or have the consent of a parent or legal guardian
  • Provide accurate, current, and complete information
  • Use the platform only for lawful personal use

For email marketing and customer communications, we use Mailchimp, a provider compliant with international privacy standards including GDPR and CAN-SPAM. You’ll only receive marketing emails if you opt in, and you can unsubscribe anytime. 

3. Account Responsibility

Through your secure SpecXSmart account, yoaYou are responsible for safeguarding your login credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts for misuse or violation of these terms. u can view and manage:

SpecXSmart’s tools (including SpecXSizer and SpecXViewer) are designed to assist your decision-making. However, the final selection of frames, lenses, and customizations is your responsibility.

5. Pricing & Payment

All prices are listed in TTD (Trinidad & Tobago Dollars) and are subject to change without notice. We accept cash, Linx, and all major credit/debit cards. Delivery or pickup fees may apply depending on your selection. 

6. Delivery & Fulfillment

Estimated delivery timelines are provided by your Xpert Advisor at the time of order confirmation. While we aim to meet these timelines, delays may occur due to production, availability, supplier delays and/or third-party courier issues. 

7. Returns & Refunds

Due to the custom nature of most products, returns and refunds are limited. 
Returns will only be accepted if: 

  • The product is defective, damaged upon arrival, or prior to collection
  • The issue is reported within 3 days of receipt or collection

Please note: Prescription lenses and customized frames are non-refundable unless covered by the above conditions. 

8. Prescription & Health Information

Ultimate Eyewear Ltd. provides eye exams for all SpecXSmart users. 

If you upload an external prescription: 

  • You are responsible for ensuring it is valid, accurate, and up to date
  • We are not responsible for any issues resulting from incorrect or expired prescriptions, or input errors

Note: We do not verify the accuracy of externally uploaded prescriptions. 

9. Technology Use & Intellectual Property

All SpecXSmart content, branding, software, and digital tools (including SpecXSizer, SpecXSorter, SpecXViewer, and SpecXFusion) are the intellectual property of Ultimate Eyewear Ltd. 
You may not copy, distribute, modify, or reverse-engineer any part of this platform without written permission. 

10. User Content & Testimonials

If you submit reviews, testimonials, photos, or feedback, you grant us permission to use this content for promotional purposes across our website, social media, and advertising platforms. 

11. Privacy

We take your privacy seriously. Please review our Privacy Policy for details on how we collect, store, and use your personal information, including facial scans and prescription data. 

12. Limitations of Liability

SpecXSmart is not liable for: 

  • Misuse of our platform or tools
  • Errors in user-submitted data or prescriptions
  • Fit or satisfaction issues from user-selected products
  • Delays caused by third-party partners or delivery services
  • Disruptions caused by technical errors or outages

13. Right to Refuse Service

We reserve the right to decline service or cancel any order that appears fraudulent, abusive, or in violation of our terms. 

14. Force Majeure

We are not liable for delays or failures caused by events outside our control, including but not limited to: natural disasters, government restrictions, internet outages, or supplier disruptions. 

15. Changes to Terms

We may update these Terms & Conditions at any time. Updated terms will be posted on the website. Continued use of the platform indicates acceptance of the changes. 

16. Governing Law

These Terms & Conditions are governed by the laws of Trinidad & Tobago. Any disputes will be resolved through the courts of that jurisdiction.
